If you were 12 and he was 17 and you said yes, is that kind of sexual abuse situation punishable by law?

I know there's a statutory rape law, but if the dude was under 18, how does that work out? And if anyone starts spouting jesus crap to me, or supporting 'I love you's, you're not doing anything but pissing me off.
